Can a warrant be invalidated in Tasmania Australia for any reason?
I have had a visit by the police in the form of a warrant i was locked up on my birthday and apparently i yelled at and threatened harm to two people….I wasn’t done for that I was walking away from the police station walked around the corner walked half way up the road heard a hey what are you doing stop and i thought it was one of the people i told that i was going to a friends place so i yelled i am going to his place and kept walking i never turned around, then before i knew it from behind me was a pair of hands grabbing mine and holding them behind me i yelled out what the (expletive) are you doing man and when i was turned towards the station i saw a blue uniform and went what ever as it was a police officer and i was done… after 4 hours of waiting in a cell to find out the charge, the friend whose place i was going back to found out i was in there instead of being at the party so he went and got hold of my parents to contact the police and get me out…..i was done for failure to obey an officer of the law and use of abusive language but released into my own custody.Hey i didn’t know who it was behind me! Now at the time i had one bottle of jack and another type of bourbon in me.I really wasn’t in a fighting mood or anything i was happy and wanting to go back to my party but i had to go home,I was bailed with the provisions i don’t enter the town limits that night till 7 in the morning on the 7th of july.The other limits the police Street Graffiti Products chucked on there is stupid it said i cant go into the main area of town which my friend lives on the edge street of the restriction so now till court i cant stay there over night as i am banned from 9 at night till 7 in the morning from being in the centre of town.That’s not the best part.I slept woke up all that, at 5 in the afternoon the police came up with a warrant involving graffiti that was done either that night or early in the morning and i live 5.5k away from town i didn’t do it being drunk and having no vehicle makes it hard to go down town when your asleep.The warrant had marijuana products or something on it as well i was told by my parents,I never was shown the warrant. Well i had seeds from ages ago all labeled and that the funny thing is i should have clicked about a warrant and dumped the seeds but i basically forgot about them, I had ample time to have gotten rid of them because a cop came up before hand and told me there was others coming up with a warrant and my father had that cop talking for the 20 minutes that it took for the others to arrive with the warrant. I feel that they added the marijuana as an add on to something because i have been done before twice for growing marijuana. Is there any law or legal measures i can claim as a defense apart from the fact i had reasonable time to remove the seeds from my house.Or some reason that can invalidate their warrant? Please note they came up looking for graffiti products i showed them cans of spray paint in my fathers shed and they took nothing for comparison and i never knew but my father said there was more spray paint in a oven in the shed as well and there was 30 cans more in there but the police never found them because they never asked dad what they were looking for and never took samples of the paint or pictures of any paint cans for the graffiti stuff NOW I KNOW i am being railroaded as i have grown marijuana and been caught twice before i DON’T grow it to sell I believe in the rights of people to smoke or consume what they want if they don’t hurt anyone else. So does anyone aka lawyer etc know preferably a Tasmanian lawyer or Australian but any input from others lawyers barristers or normal people will help, is there any legal way i can say that the search warrant was invalid or just a ruse to come in and search for drugs? THANK YOU ALL FOR YOUR TIME. i am seeking advise from a legal aid lawyer as i feel i have been done in by the police because i live in a rural area. There is another person who was in the lockup with me i was told he got his hands checked for paint why not have a warrant to search his premises? Please note as a final thing we live 5.5k away from town and there is no proper addresses apart from plot numbers and the police put 161 in front of our highway name on the first warrant i was told as i never saw it and we live next to my uncle who claims that address number i hope that invalidates the warrant……ANYWAY I will leave this novel sized question and hope there is someone who can help me out.
